Terms and Conditions: The Fathering Project – Dad’s Joke Championship

The Competition

  1. These terms and conditions relate to the “Dad’s Joke” championship (Competition).

The promoter of the Competition is The Fathering Project (ABN 67 605 348 776), Level 8, Suite 4, 247 Alfred Street, North Sydney, New South Wales 2060, telephone number 1300 328 437 (Promoter).

  1. By entering the Competition, you accept these Terms and Conditions (including any subsequent variations to the Terms and Conditions.)

If there is any inconsistency between these Terms and Conditions and anything else that refers to the Competition, these Terms and Conditions prevail.

Eligibility

  1. Subject to clauses 6, 7 and 11, entry to the Competition is open to individual permanent Australian residents who are 18 years of age or over at the date of entry.

Directors, officers, management and employees of, or contractors to, the Promoter or its associated entities/related bodies, and their immediate family members (whether or not they live in the same household) are not eligible to enter the Competition.

  1. Entrants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the Prize (as defined below in clause 13) to the ineligible person, it may require the return of the Prize or payment of its value to the Promoter.

Entry

  1. The Competition commences at 3pm AEST on November 15, 2022, and entries close at 11.59pm AEST on January 15, 2023 (Promotion Period). Late entries will not be accepted.

To enter the Competition, eligible entrants must, within the Promotion Period, go to the online entry form located at https://thefatheringproject.org/dad-jokes-australia/ to:

  • complete all fields;

in 35 words or fewer answer the question: ‘what is your best dad’s joke’ (Question); and

  • pay $5.00 via Strip (excluding internet connection, mobile, telephone and any other third party charges).
  1. Entries that contain any incorrect personal information, incorrect contact details of the entrant, incomplete entries or are determined by the Judges (at their complete discretion) to not be family friendly will be deemed invalid entries and will not be eligible.

The Promoter may, at its sole discretion, disqualify any entrant if it reasonably believes that the entrant has breached any of the terms and conditions, tampered with the entry process or engaged in unlawful or improper conduct calculated to jeopardise fair and proper conduct of the Promotion. Any Entrant disqualified under this clause is prohibited from any further participation in the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Prize

  1. There are three (3) prizes (Prize), each Prize consisting of a $100.00 gift voucher from Prezzee Gift Card.

Conditions

  1. The Prize cannot be redeemed for cash or exchanged for an alternative. The Prize Winner will not receive any compensation or cash refund for any unused portion or value of the Prize.

The Prize Winner must be 18 years of age or over at the date of entry.

  1. Other transport, spending money, other meal costs and other expenses associated with claiming or using the Prize are the responsibility of the Prize Winner.

The Prize remains the property of the Promoter until lawfully claimed by the Prize Winner to the satisfaction of the Promoter pursuant to these terms and conditions.

Judging and Winning

  1. All complete entries submitted during the Promotion Period will be judged by a panel of two (2) ambassadors and one (1) board member of the Promoter (Judges) who will determine, in their sole discretion, which entrant best answers the Question (Prize Winner).

The Prize Winner will, wherever possible, be contacted by email by January 31, 2023.and will be advised by the Promoter on how and when the Prize will be provided if it is accepted.

  1. The Prize Winner will be announced and have his or her details published on the Promoter’s website and across the Promoter’s social media platforms.

The Prize Winner will have until 4.00pm on February 7, 2023, to accept/claim the Prize.

Provision of Prize

  1. The Prize Winner’s Prize will be provided within 7 working days of the Prize Winner accepting/claiming the Prize.

If the Prize Winner cannot be located the Prize will be kept until 4.00pm on February 7, 2023 (Claim Deadline). If, at the end of the Claim Deadline, either the Prize Winner cannot be located following the Promoter’s reasonable efforts, or if the Prize Winner does not accept/claim the Prize by that time, the Prize Winner will forfeit the Prize and the Prize will be awarded to the entrant whose answer to the Question was judged by the Judges, in their sole discretion, as second best. In this case the subsequent Prize Winner will, wherever possible, be contacted by email by February 8, 2023.

  1. Any subsequent winner of a previously forfeited Prize (also referred to as a Prize Winner) will be announced and have his or her details published on the Promoter’s website and across the Promoter’s social media platforms.

If the Prize is delivered by post, a Prize is deemed to be delivered to the Prize Winner at the time the Promoter or the Promoter’s nominated prize supplier dispatches the Prize to the Prize Winner’s nominated postal address or email address (as relevant). The Prize may be delivered on a date that is greater than 10 days after a Prize Winner is decided.

General

  1. All entries will be the property of the Promoter and may be used for promotional purposes.

All entrants acknowledge that the Promoter has the right to publicise and publish the entrant’s name, photographs and likeness.

  1. The Prize Winner must provide photographs if required by the Promoter and acknowledge that the Promoter has the right to use those photographs for publicity in any reasonable manner it sees fit without compensation to the entrant and/or his or her guest. The Prize Winner agrees to participate in any news and other media activities surrounding the Competition (e.g. interview and photo for pages of the Promoter’s website).

It is the entrant’s responsibility to advise the Promoter of any change of personal details and contact details by providing written notice to the Promoter at the above address specified in clause 2. The Promoter bears no responsibility for incorrect personal or contact details which results in individual entrants being invalid from participating in the Competition due to incorrect details on their entry form.

  1. The Promoter is not responsible for any incorrect or inaccurate information, either caused by an entrant or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone,

The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in the Promotion Period. The Promoter also accepts no responsibility for any tax implications that may arise from Prize winnings in the Competition. All entrants should seek independent financial advice about such matters.

  1. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside the Promoter’s reasonable control that would reasonably prevent the Competition from occurring or the Prize from being granted or used, the Promoter is entitled to cancel, terminate, modify or suspend the Competition and/or the Prize subject to written direction from any relevant regulatory authority if required.

If for any reason the Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the Promoter’s control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter is entitled in its sole discretion to cancel, terminate, modify or suspend the Competition subject to written direction from any relevant regulatory authority if required.

  1. The Promoter reserves the right to vary these terms and conditions at any time (without prior notice) without liability to any entrant or any other person, subject to applicable laws. These terms and conditions and any varied terms and conditions will be available on the Promoter’s website.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  1. In the event there is a dispute concerning the judging of the entries, the conduct of the Competition or the awarding of a Prize, the decision of the Judges and/or Promoter will be final and no correspondence will be entered into.

The entrant releases the Promoter and its related bodies from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the Prize Winner from loss or damage to any physical property of the Prize Winner, or any injury to or death of the Prize Winner or any other person arising out of, or related to, or in any way connected with the Prize, using the Prize or participating in the Competition.

  1. In the event of any third party, other than the Promoter, cancelling any event or failing to provide any goods or services relating to the Competition including the Prize, the Promoter will not be held responsible.

Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion. This includes (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Winner or entrant; (e) taking and/or use of a Prize; (f) any late, lost, damaged or misdirected Prize delivery due to any reason beyond the reasonable control of the Promoter, including any error in the Prize Winner’s nominated postal address (if applicable) and any dealings by the individual who does or purports to participate in the Competition.

  1. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.

 

Privacy and Collections

  1. The Promoter collects personal information in order to conduct the Promotion. By participating in the Promotion, the entrant also acknowledges that a further purpose for the Promoter’s collection of the entrant’s personal information is to enable the Promoter to use the information to contact the entrant in relation to the Promoter’s products and services.

Personal information collected by the Promoter to conduct the Promotion will be stored, used and disclosed by the Promoter for the purposes identified in these terms and conditions, and in accordance with the Privacy Act 1988 (Cth) and the privacy policy at https://thefatheringproject.org/ (“Privacy Policy“). By participating in the Promotion, each entrant is deemed to consent to the storage, use and disclosure of his or her personal information in accordance with these terms and conditions and the Privacy Policy. The Privacy Policy also contains information about how individuals can access and amend their personal information or make complaints about privacy matters.
